I guess I'm the odd man out on this one, and I have been a ham operator for a long time, but you don't sign a contract then go beg the government to change the contract. first off they should have asked question about ham antennas and any other concern if they were not allowed they should have picked another place to live, if enough people refused to live in that community they would change the contract if they didn't read the contract and sign blindly then they get what they agreed to. but I guess no one has to keep their side of contracts just move in then raise hell until the other side has to live with what they want. ( now this truly snowflakes in action) sorry if I stepped on any toes but contracts are contracts need to read before signing and if you don't understand what your signing have someone that understands contracts read there no hurry.

Riden_Da_Golwing, while I generally agree with your statement "if you don't like the rules, don't go there". The real problem is with changing the rules. If someone bought there and there were no rules against something, and later the HOA (or the town) banned it, who is breaking the contract? I have heard many complaints were something was NOT spelled out in the agreement and later the HOA determined it was banned while there were no WRITTEN rules against it. I HATE HOAs and I am sure they would not want me either. I would do everything I can to aggravate them!!!

I'm new here, so I'm just now seeing this. To me, private contracts are sacrosanct. It's not the government's privy to change that. As already stated, if you don't like the rules, don't buy there. Changing after the fact is another matter. I'm a ham and I've contacted the ARRL on more than one occasion telling them my opinion of their continued action.
Luckily, this failed to go any further.
BTW, I have a temp residence in a "manufactured home community" (AKA trailer park) in another state and the rules are "NO PETS of any kind for any reason, nor pet sitting, etc." But now, because of the Feds, if someone gets "a piece of paper" from their doc saying they need a comfort animal, that trumps private contract (lease agreement). The management doesn't like it, but their hands are tied.
Same concept. They also don't allow any antennae and I certainly won't try to bring the ham rig that I have here in WY.

I've had my fill of Neighborhood Nazis. It's not bad now, I get along great with the neighbors, but in the past I've had some ridiculously nosy busybodies in the neighborhood complaining about everything from putting out my trash a day early (because I was going out of town) to claiming that the sun reflecting off the windshield of my van was killing their hedge. I'm damn sure not going to give the Neighborhood Nazis any power to wield over me by signing onto a HOA.

My daughter has learned the hard way. She bought a house in a HOA neighborhood, and got one complaint after another from the HOA about things the PREVIOUS owner did. For example they claimed that the previous owner installed an UNAPPROVED DOOR for crying out loud! There is nothing unusual about the door, it just wasn't approved by the HOA. WTF????? Why they didn't take all this up with the previous owner I have no idea. But instead if fell on her to correct all the prior transgressions even though they weren't her doing and they were for silly things like an unapproved door.

I would never live anywhere that has a HOA. However, the land that I lease from the Forest Service comes with it's own share of rules. For example I have a road that crosses FS land and I put up No Trespassing signs. They called me and said the signs didn't meet their criteria and needed to be worded according to their requirements. Plus they needed to be white with black lettering. I guess the Red and Black No Trespassing signs that I put up just looked to darn angry. Fortunately this silliness only applies to the signs on the FS leased land.

The approval of the Parity Act protects hams constrained by an HOA, but also hams as myself that live in rural areas that have land with long ago filed C & Rs that petty local township bureaucrats (i.e., zoning officials) interpret as not allowing ham antennas of various forms on 2 acres no less!

My mad dog lawyer took them to school and solved the problem but that $2000 would have been much better spent on a new tower!

No, it doesn't "protect hams" but rather overrides private contracts, agreements, between private parties that each willingly agreed to in advance of buying property.
It works both ways: do you want the federal government meddling in your private affairs or not? Do you want your neighbor getting a barking dog even though your community or apartment complex has a NO PETS rule? Do you want the passenger seated next to you on a flight to bring a a parrot, iguana, or miniature horse, and have it next to you? And YOUR only choice is to get off the flight if you don't like it?
It's always attractive when Big Brother is on your side, otherwise not so much.
